In consideration of a $100.00 deposit (NOT REQUIRED for NEW First Year AND TRANSFER STUDENTS who have NEVER resided on campus prior to the upcoming Academic Year AND WHO HAVE ALREADY SUBMITTED THE REQUIRED $300 DEPOSIT), Wilkes University offers to reserve and assign a space in a University owned residence hall and provide dining accommodations for the entire Academic Year based on the terms and conditions contained herein. Room assignments are subject to availability of space at the time the agreement is received by Wilkes University Residence Life. Residence Life reserves all rights in terms of acceptance of this agreement. The University reserves the right to assign and reassign all residence hall living spaces. All rates herein are subject to final approval by the Board of Trustees.

Accommodations: Residence hall rooms are single, double, or triple rooms. The University reserves the right to determine the number of students assigned to a room and/or to change room assignments if so required. Roommates will be assigned by the University without regard to race, religion, color, creed, national origin, or disability. The designated space in the residence hall is for the exclusive use of the Wilkes University student to whom it was assigned. Room rates for this Academic Year are expected to be as follows:
Double/Triple Room: $6,880/Year Single Room: $7,230/Year Apartment style: $7,630/Year
Dining Plans: ALL RESIDENT STUDENTS ARE REQUIRED TO PARTICIPATE IN ONE OF THE COLONEL DINING PLANS BELOW. FIRST TIME FRESHMEN (STUDENTS WHO HAVE NOT PREVIOUSLY BEEN ENROLLED FULL TIME IN COLLEGE OR HAVE EARNED FEWER THAN 24 CREDITS) MUST CHOOSE THE COLONEL GOLD OR COLONEL GOLD PLUS PLANS ONLY. No credit or refund is allowed for meals not eaten by a residence hall student. The student’s official identification card will be used to gain access to the dining facilities. The dining plan is for the sole and exclusive use of the student who contracts for the service. Dining plan level changes to fall semester contracts are not permitted after June 1. Dining plan changes for spring semester are permitted only during the official dining plan change period of September 15 through October 31.

*This plan is only available to resident students that have completed 90 credits or more by the first day of classes.
Dining Dollars & Flex Dollars: Dining Dollars are exclusive to the Colonel Meal plans and can only be redeemed at the Henry Student Center Food Court, Rifkin Café, Café a la Cart or other dining service outlet. Flex Dollars can be purchased at any time at the Wilkes Student Services desk and can be redeemed at any participating vending outlet, including the dining facilities.
I/We agree and fully understand that the contract is for the FULL ACADEMIC SCHOOL YEAR, or any remaining portion thereof, and is binding for that period if the student is to enroll or continue enrollment. I/We guarantee full and prompt payment of all sums payable by said student to University. I/We have read and understand the terms and conditions of this agreement (on reverse). I/We further agree to abide by all campus regulations as outlined in the Wilkes University Bulletin, Student Handbook and attached Residence & Dining Contract terms and conditions, recognizing the fact my housing contract may be cancelled at any time should my actions be deemed inappropriate by Wilkes University.

Terms and Conditions for the 2010–2011 Residence and Dining Contract
Please read and understand all of the terms of this contract prior to completion. This contract highlights some, but not all, of the policies regarding living in the residence halls. All students will be expected to abide by all of the policies outlined in the Wilkes University Student Handbook and the Wilkes University Bulletin.
Term Of Contract
THIS RESIDENCE AND BOARD CONTRACT IS FOR THE ENTIRE ACADEMIC YEAR, WITH THE EXCEPTION OF OFFICIAL UNIVERSITY VACATION PERIODS. Students are held to this contract for the entire academic year, unless they formally withdraw from the University, registration is terminated, or the contract is canceled by the University. Housing for students during vacation periods will be at the decision of the University and granted only for academic program requirements or University sponsored athletics. Students granted this privilege may be expected to move to another residence hall. The University reserves the right to use residents’ rooms during official vacation periods. Students must vacate the University Residence Hall within 24 hours after their last final examination or within 24 hours after the termination of this residence hall contract. This agreement is to be construed as a license and is not intended to and does not create a landlord/tenant relationship between the University and the student. This contract is governed by the rules and regulations established in the current Student Handbook. The University may terminate this agreement at any time if the student fails to comply with University regulations or any provision of this agreement.
Goods And Services
The goods and services with which the student will be provided shall include: a board dining plan (see DINING PLANS), laundry facilities, and a living space furnished with a bed, desk, desk chair, dresser and wardrobe/closet space. Cleaning services are provided for common use areas, including bathrooms in common areas and Evans Hall bathrooms. One telephone line per unit with on-campus and local telephone service, one basic cable television outlet per unit, and one Ethernet jack per unit. Fees And Deposits
a. Room & Board Deposit
i. For current and resuming students, a deposit of One Hundred Dollars ($100.00) must be included with this contract. The $100 Room & Board deposit is required even if the student is or will be on a scholarship or other financial aid that covers full room and board. This deposit will be applied to room charges after occupancy.
ii. For entering first year and transfer students: No additional deposit is required with this agreement.
b. Comprehensive Fees - The student shall pay the full cost of room, board, and deposits upon the receipt of an invoice from the University.
c. Returning Students – The $100 Room & Board deposit fee is non refundable after June 1.
d. New Students - The $300 Tuition Deposit fee is not refundable.
a. Cancellations - Cancellations are governed by the terms as outlined in the University Bulletin. Failure of the student to occupy the reserved residence hall by the first day of classes of either semester without prior written notification to the University will result in forfeiture of the room without refund of the room fee.
b. Refund Policy – All refunds of Room and Board charges are governed by the Refund Policy as defined in the current Student Handbook.
Personal Property/Access/Property Damage
Authorized University and residence hall personnel may enter a student’s room at anytime for cleaning, maintenance, or repairs; in the event of emergencies; or when reasonable grounds indicate that a crime is being committed. The University cannot and does not assume any responsibility for the loss, damage, or destruction of a student’s personal property that is stored in the residence halls. Students are advised to insure their property against fire and theft by securing individual homeowners insurance and by keeping their room doors as well as the doors to their residence hall locked at all times. Rental of space does not imply ownership of that space; nor does it give license to alter or destroy. Room occupants will be assessed for damages such as defaced plaster or woodwork, broken windows, damaged furniture, or the deterioration of property resulting from misuse on the part of the occupant. Similarly, any property damage to hallways, lounges, or lavatories (common areas) will be charged to the residents in the living unit.
The resident is expected to abide by all Wilkes University rules and regulations published in the Student Handbook, letters and memorandums, and the University Bulletin. Residents should understand that the University may take appropriate action, including termination of this contract, for conduct found by the University to be in violation of such rules and regulations, or which is otherwise detrimental to the health, safety, or welfare of other Wilkes University students, administration, faculty or staff.
